1. General
By enrolling in any course, program, or service provided by Schipfe Capital ("Schipfe Capital", "Company", "We"), you ("Student", "Participant") agree to comply with these Terms & Conditions. If you do not accept these Terms, you must not use or access our services. These Terms govern all websites, online courses, educational materials, mentorship programs, and associated services (collectively, "Services").
2. Purpose & Scope
Schipfe Capital provides educational programs in trading and ETFs, including access to course content, mentorship, simulations, and learning resources. All Services are strictly for educational purposes. We do not provide financial, investment, tax, or legal advice. Participation in real trading or investing is at your own risk.
3. Enrollment & Contract Formation
- Enrollment is confirmed upon submission of the registration form and full or initial payment according to the selected plan.
- We reserve the right to deny enrollment if the course cannot operate effectively due to low participation or other logistical reasons.
- Students must provide accurate personal information. False information or failure to pay may result in cancellation of enrollment.
- Students under 18 years old are not permitted to enroll.
4. Course Delivery, Platforms & Physical Materials
- Courses are delivered via external platforms, including but not limited to Zoom.
- Access credentials and study materials will be sent via email 1–2 days before the course begins.
- Students are responsible for ensuring a stable internet connection and compatible devices.
- During live sessions, students must keep their cameras on so that their faces are visible.
- Physical learning materials (including but not limited to books, printed materials, or educational tools), if provided, are supplied free of charge.
- The shipping and return shipping costs are fully covered by Schipfe Capital.
- The student is required to return all physical materials within ten (10) days of delivery.
- Failure to return the materials within this period, or returning them damaged beyond normal use, may result in additional charges or claims for replacement costs.
5. Student Conduct & Discipline
Disciplinary rules: Students must adhere to the following:
- No harassment, threats, or abusive behavior toward instructors or other students.
- No discrimination based on race, gender, religion, nationality, sexual orientation, disability, or any other protected category.
- No offensive, obscene, or disruptive behavior during classes or on course platforms.
- No unauthorized recording, sharing, or distribution of course content.
Automatic expulsion: Any violation of these rules may result in immediate and automatic removal from the course without the possibility of refund or claim.
6. Disclaimer & Risk
- All educational content is provided "as is" and "as available" without warranties of any kind.
- We do not guarantee specific financial outcomes or trading results. Your success depends on your application, effort, and market conditions.
- Students assume full responsibility for any financial decisions made after completing the course.
7. Intellectual Property
- All course content, materials, and resources are the exclusive property of Schipfe Capital or its licensors.
- Content is provided solely for personal, non-commercial use.
- Reproduction, distribution, or public use without permission is prohibited and may lead to legal action.
8. Payment & Refunds
Payments must be completed according to the plan selected. Non-payment may result in suspension or denial of access.
Refunds:
- Full refunds will be issued only if Schipfe Capital cancels the course.
- No refunds will be issued for voluntary withdrawal after course access begins, except where required by Swiss consumer law.
- Payment disputes must be submitted in writing within 14 days.
9. Data Protection & Privacy
- Personal data will be collected and processed according to Swiss Data Protection Law (FADP).
- Data will be used for course delivery, communication, and educational purposes only.
- Students can request access, correction, or deletion of personal data by contacting Schipfe Capital via email.
10. Student Responsibilities
- Students must engage actively, complete assignments, and use provided resources responsibly.
- Students must not distribute, sell, or misuse course content.
- Students must maintain camera visibility during live sessions.
- Misuse or violation of rules may result in suspension or termination without refund.
11. Limitation of Liability & Indemnification
- Schipfe Capital is not liable for any direct or indirect financial losses, damages, or other consequences arising from participation in courses or application of knowledge.
- Students agree to indemnify and hold harmless Schipfe Capital and its affiliates from any claims, damages, or losses arising from their use of the Services.
12. Termination
- Schipfe Capital may terminate access for breach of terms, misconduct, or legal requirements.
- Termination does not relieve the student of any payment obligations.
13. Governing Law & Jurisdiction
- These Terms are governed by Swiss law.
- Any disputes shall be submitted to the competent courts of Zurich, Switzerland.
14. Amendments
Schipfe Capital reserves the right to update these Terms at any time. Continued use of the Services constitutes acceptance of such changes.
